Intercountry Adoption
Nepal has signed the Hague Convention on Protection of children and Co-operation in Respect of Intercountry adoption on 28 April 2009. This has paved the way for systematic adoption from Nepal.
A person who wants to adopt a child from Nepal should file an application at the Investigation, Recommendation and Monitoring Committee of the Ministry of Women Children and Social Welfare of Nepal, through listed foreign organization/agency or their embassy in Kathmandu or any other designated embassy. After necessary processing, the Committee makes the necessary recommendation to the Ministry.
Who can adopt
- Married couple who have completed at least four years of their marriage or an unmarried person, widow/widower, divorcee or, judicially separated woman who has completed thirty five years of age, but not crossed fifty five years of age
- The age difference with the child to be proposed for adoption should be at least thirty
- An alien shall not be given an approval to adopt a male child if she/he already has a son, and a female child if she/he already has a daughter.
- A child to be adopted shall be younger than the alien's son or daughter, if she/he has any.
- Provided that where an alien has already adopted a Nepali child, this Section shall not bar to adopt the sibling of such child by the same alien.
Required Documents:
- A consent letter granted by the government of the adopter’s country for adoption from Nepal
- A guarantee letter written in favour of the adopter by the government of the concerned country or Nepal based embassy of that country or any other designated embassy specifying that the adopted child shall enjoy the same status at a par with the biological child of the adopter.
- Applicant's birth registration certificate,
- A document certifying the marital status of the applicant,
- Applicant's family description, including the birth registration certificate of his/her son or daughter or adopted son or daughter, if any,
- Medical certificate from a registered medical doctor
- Certification of Good Conduct
- A document certifying applicant's property and income source,
- A photocopy of applicant's passport,
- A report containing the applicant's social and psychological condition
